Two brothers from Iowa will face another trial on charges of fourth-degree felony assault in a brawl with a Minneapolis police officer outside Hooters on Block E last May.

Hennepin County District Judge Steven Pihlaja discharged the jury late Thursday afternoon when he learned of an impasse in the deliberations. The jury began discussing the case Tuesday.

Hennepin County Assistant District Attorney Dan Allard said prosecutors intend to retry Tanner McCormack, 29, and Tyler McCormack, 23, who are accused of assaulting Officer James Lynch.

Lynch was off duty but working security on Block E.

Lawyers for the McCormacks say that they acted in self-defense and that Lynch was the aggressor. The episode was captured on security cameras and shown to the jury many times.

Hennepin County Attorney Mike Freeman said the hung jury is disappointing. "That happens. It's part of the system, but we're part of the system, too, so we're not going to sit here and criticize it. We're going to retry it," he said.

The McCormacks, of Cedar Falls, Iowa, were in town for a bachelor party and were going to have dinner at Hooters when Tanner McCormack was told by the manager to leave because he was drunk.

In the hall, he encountered Lynch and called him fat. Defense lawyers Jill Clark and Jill Waite said that angered the officer, who pushed Tanner down. Tyler then tried to help his brother, the lawyers said.

But prosecutors said Tanner McCormack was looking for a fight that evening. The video is not available to the public because it will be used as evidence in the retrial.
