A Maplewood police officer on leave for allegations he sexually assaulted a 17-year-old girl was not charged in that matter, but remains off the job as another part of the case is forwarded for possible charges.

The Washington County attorney's office declined last week to charge officer Joseph Tran in connection with criminal sexual conduct allegations involving an Eagan girl.

The incident allegedly occurred at Tran's Stillwater home Oct. 6, according to Fred Fink, head of the Washington County attorney's criminal division. It was reported to Stillwater police Oct. 8.

Stillwater police confirmed the report and said that another allegation that Tran provided alcohol to minors will be referred to the city attorney's office for possible charges.

Maplewood acting Police Chief Dave Kvam said in a written statement that Tran was placed on leave Oct. 10 when the department was notified of the sex assault allegation. He will remain on leave pending the alcohol case.

Tran is a school resource officer. He has been with the department since 2006 and has no disciplinary actions on his record, Kvam said.

Fink said the office reviewed the evidence in the sex assault case and determined last week that it could not be proven beyond a reasonable doubt.

The allegation was that the girl and a friend were at Tran's home, drank alcohol and then the girl and Tran had sexual intercourse, Fink said.

Fink said there was no evidence of force or coercion.
