Boston Scientific Corp. has sued a former salesman of cardiac rhythm products, claiming he was overpaid $200,605 due to an "administrative error."
The lawsuit, filed in U.S. District Court in Minnesota by the Natick, Mass.-based medical technology company, claims Michael McCormick has already received 90 percent of his guaranteed commission for 2010 and 2011.
When the Natick, Mass.-based medical device company notified McCormick of the error in January and suggested a new employment agreement "that contemplated accounting for overpayment," he allegedly rejected the offer. Last week, McCormick, of Tucson, Ariz., resigned from the company "without payment of the unearned compensation," the suit states.
A day later, Boston Scientific filed suit against McCormick.
The suit alleges McCormick entered into a five-year employment agreement that guaranteed him income "in excess of $1 million." The agreement did not permit McCormick to terminate his employment, court documents state.
McCormick has worked for Boston Scientific as a sales rep in the Tucson area since 1999, selling heart defibrillators and pacemakers to hospitals and clinics. He could not be reached for comment Friday.
