Tuesday noon deadline to withdraw ballot challenges

Secretary of State's office told Democrat Mark Dayton and Republican Tom Emmer's lawyers the canvassing board will go through the challenges by county -- starting with the counties where there were the most challenges.

The secretary of state's office has told gubernatorial candidates attorneys they have until noon Tuesday to withdraw challenges otherwise the state canvassing board will start examining the ballots Wednesday morning.

According to a spreadsheet the office provided Democrat Mark Dayton and Republican Tom Emmer's lawyers the board will go through the challenges by county -- starting with the counties where there were the most challenges.

That means the ballots from Waseca will be up first unless Emmer's attorneys quickly remove those challenges. Many of those challenges were on ballots that had writing of any kind on them.

Last week, Judge Gregg Johnson, a member of the canvassing board, called some of the challenges from the Emmer team "ludicrous."

The Tuesday noon deadline gives secretary of state officials to begin removing ballots from the stack of challenged ballots starting Tuesday afternoon with plans to have the removal done when the canvassing board starts their examination Wednesday at 9 a.m.

"To provide adequate preparation time for the meeting, if you provide notice of any withdrawn challenges after noon on Tuesday, the ballots will be presented to the State Canvassing Board and the challenges will be withdrawn orally at the meeting," the office told the candidates' attorneys.
