Prosecutors halt case against sheriff’s captain accused of stealing item from lab for fishing trip

Prosecutors have put on hold their felony case against a onetime Hennepin County sheriff’s captain who was charged with stealing a piece of equipment from the Sheriff’s Office ahead of a fishing excursion last winter.

Steven George Labatt, 58, of St. Michael, Minn., was charged on Nov. 4 in District Court with felony theft in connection with stealing a gasoline-powered generator from the forensic science laboratory that he directed at the time.

On Feb. 5, he agreed to enter an adult diversion program, meaning that prosecution on the theft count is suspended while Labatt fulfills requirements that would lead to dismissal of the case after six months.

The requirements include that Labatt attend classes and programs as recommended by diversion staff, complete 12 hours of community service or an equivalent and remain law-abiding.

He’s also been ordered to pay restitution, something his lawyer said he did in April.

The Hennepin County Attorney’s Office says such an agreement is a standard disposition in certain cases when the defendant has no felony criminal record.

Sheriff’s Office personnel noticed in early March that a generator was missing. Numerous emails soon went out to Labatt and other staff members asking that it be returned.

Labatt admitted taking the generator and using it for an ice fishing trip from Feb. 1-28, 2025, only to realize after he returned home that he left it on the lake.

“[He] did not go back to find the generator,” the complaint said. “[Labatt] did not try to contact anyone or make arrangements for anyone to attempt to find or recover the generator after realizing he left it on the lake.”

The cost of the new generator was $1,209. Its gasoline can was also missing and replaced for $26.97, with 2 gallons of gas included. The Sheriff’s Office also paid $80 to put Air Tags on the generator.

Along with failing to respond to Sheriff’s Office staff inquiries about the missing generator, Labatt did not replace or offer to replace it until after a new one was purchased.

The Sheriff’s Office crime lab works with 35 law enforcement agencies in the county along with the State Patrol and federal law enforcement agencies.

Labatt had risen through the Sheriff’s Office ranks, starting at the jail in 1989, then moving on to the water patrol, the crime lab unit, investigations and the enforcement services division.

He became the forensic science lab’s director in January 2021 until he was “separated from employment” on April 30, according to a Sheriff’s Office spokeswoman.
