MN Supreme Court dismisses shutdown suit from four GOP Senators

The court didn't deal with the issue of what can be spent and can't in a shutdown -- just dismissed the way the Senators asked for guidance on the matter

The Minnesota Supreme Court dismissed the shutdown lawsuit from four GOP state senators.

The court didn't deal with the issue of what can be spent and can't in a shutdown, which was at the root of the senators' suit -- it just dismissed the way the Senators asked for guidance on the matter.

The senators -- Warren Limmer, Sean Nienow, Scott Newman and Roger Chamberlain -- had asked to court to put strict limits on any shutdown spending besides that required by the constitution, federal mandates and ongoing appropriations. Any other spending would be unconstitutional, they said.

Both DFL Attorney General Lori Swanson and DFL Gov. Mark Dayton opposed the senators move.

The senators may yet have another bite at the apple. They also asked Ramsey County District court to rule on the issue.

NOTE: Supreme Court Chief Justice Lori Gildea recused herself on the matter.
