A Duluth physician has been reprimanded for allegedly touching 21 female patients inappropriately during what were described as "unconventional" medical exams.
Dr. Jed E. Downs, 51, reportedly would close his eyes and make "unusual sounds or facial expressions" while examining female patients, according to an investigation by the Minnesota Board of Medical Practice. Downs denied any improper conduct but acknowledged that his actions may have been perceived "as invasive or inappropriate." He was one of four Minnesota physicians disciplined this month by the board.
Downs, who specializes in preemployment exams and workers' compensation cases, examined female patients from an "unconventional position," sitting behind them, the board found. He failed to consistently provide female patients with a gown or drape during exams, and refused to stop the exams when patients complained of pain or discomfort, the board found. In addition to the reprimand, Downs agreed to pay a $5,000 fine and to work with a female chaperone when examining new female patients.
The board also disciplined:
• Dr. Pastor Colon, a psychiatrist in Crystal, for hugging and kissing a female patient. Colon, 69, acknowledged that he gave the patient a hug and "a spontaneous peck on the lips," according to the board. He later admitted that the behavior was inappropriate and apologized, the board said. He agreed to take a course in professional conduct and pay an $880 fine.
• Dr. Stanlislav Kruglikov, 48, of Minneapolis for not abiding by a previous board order to abstain from drugs and alcohol. His license was suspended in 2003 because of chemical dependency problems. It was reinstated in 2005 on condition that he submit to regular drug tests, but he missed a test in June and later admitted to relapsing with alcohol.
• Dr. Denise McSherry, 41, of Thief River Falls for prescribing drugs over the Internet without a physical exam or diagnosis, while practicing medicine in Florida.
