Pushing aside an agreement for no incarceration, a judge sentenced a 21-year-old man Thursday to four months in jail for slyly photographing young females' "backsides" in his Eagan neighborhood and at a fast-food outlet and then posting the images online, where they attracted sexually oriented comments on a photo-sharing website.

Tyler M. Sauve's sentence in Dakota County District Court in Hastings followed his pleading guilty to three misdemeanor counts: one for being a public nuisance and two for disorderly conduct.

Judge Jerome Abrams, who at one time during sentencing called Sauve's behavior "creepy," rejected the deal between the city attorney's office and the defense that called for no jail time. Abrams said he can only recall a handful of times when he's turned down a brokered sentence.

The total jail time for the three counts is 120 days, minus one day's credit for time served. Sauve will also be on two years' probation, which includes a long list of requirements: attend a sex offender program, abide by restrictions on contact with minors, allow his computer to be searched, write letters of apology to his victims and refrain from using medications meant "to improve sexual function."

"We're disappointed the judge gave him that much jail time," said Jill Oleisky, Sauve's attorney. "We originally had an agreement [with the prosecution] that my client would get treatment instead of jail time. My client will attend treatment, and we hope he does well at it. He does feel bad, and he does apologize."

Sauve was originally charged with five counts of gross-misdemeanor defamation, one count of being a public nuisance and 21 counts of disorderly conduct. All but the charge of being a public nuisance and two disorderly conduct counts were dismissed.

Police learned of the photos and accompanying comments on a Russian-based website on Aug. 18 from the Wisconsin Department of Justice, which came upon the images while investigating an unrelated case. Eagan police said the photos were of fully clothed children and had been removed from the website.

The photos were of "females' backsides and also images of someone [the] defendant identifies as his 13-year-old cousin," according to the criminal complaint filed in October. There also were pictures of "the buttocks of several females working behind the counter at Jimmy John's," the court document continued.
