Jared Fogle's texts revealed in appeal of child porn sentence

Disgraced former Subway spokesman Jared Fogle, who's currently serving a 15.6-year prison sentence for conspiracy to receive child pornography and traveling to have sex with a minor, is appealing his sentence. And now prosecutors have revealed a number of his communications to justify the sentence.

In legal papers filed in federal court in Indiana on Monday, prosecutors note that Fogle engaged in sex with two minors age 16 and 17, and sought to go younger in his communications with escorts.

According to prosecutors, "Fogle had a pattern: He found adult escorts through the Internet, developed relationships with them, and offered them finder's fees to provie him with access to minors for commercial sex."

Among the communications revealed in Monday's court papers: "I'm horny again. Is your Asian friend available?"

Asked if he would also pay the adult escort, Fogle replied, "I can pay you a little finder's fee. I'll pay you big for a 14- or 15-year old."

In another communication, asked what kind of finder's fee Fogle would provide, the former sandwich pitchman replied, "Depends, on, if they can prove their age. If they can and you get me 16 or below, I'll give you 400 at least."

Elsewhere, Fogle asked, "Do you have any access to any young girls? Like 15 or 16?"

Asked why, Fogle replied, "Cause it's what I crave! … I would hook you up nicely if you did."

"How much?" Fogle was asked. "Because I have a cousin who is 15."

"What does she look like?" Fogle replied. "What does she look like? If she's good-looking I would give you 300 and her the same."

Fogle appealed his sentence late last year. Prosecutors had agreed to seek no more than 12-and-a-half years, while Fogle's team agreed to seek no less than five years.

However, in the papers filed Monday, prosecutors contended that the judge's 15.6 year sentence was just, noting that Fogle "went to great lengths to engage in commercial sex acts with underage minors. He bought and offered plane tickets. e reserved and paid for the hotel rooms, made arrangements for the commercial sex acts."

The filing continued, "A fair review of the record shows that the district court clearly sentenced Fogle only for his own concrete conduct, which was very serious … The district court did not abuse her discretion in choosing to sentence Fogle above the applicable guidelines range."
