The unlicensed driver who killed another motorist in a crash north of the Twin Cities was tracked down several miles from the scene on a rest stop bathroom floor drunk and belligerent to the point that a sheriff's deputy had to repeatedly use a Taser in order to arrest him, according to charges.

Samuel D. Moreno, 23, of Marine on St. Croix, was charged Monday in Chisago County District Court with two counts of criminal vehicular homicide, one alleging he was drunk and the other for leaving the crash scene Friday on Interstate 35 in North Branch. Other charges include a gross-misdemeanor drunken driving count and a misdemeanor count alleging he was driving after his license was revoked.

The rear-end crash occurred about 5:30 a.m. on northbound Interstate 35 in North Branch. Joffre M. Kolosky, 63, of Moose Lake, Minn. died in the collision. Moreno was not hurt.

Court records in Minnesota show that Moreno has committed many driving violations in the past five years, according to court records. They include two each for speeding, driving without a license and without insurance. He also pleaded guilty in Polk County, Wis., in 2016 to driving while impaired.

Moreno appeared in court Monday, remains jailed in lieu of $150,000 bail and has another hearing scheduled for Nov. 26. Court records do not list a defense attorney for him.

According to the criminal complaint:

A sheriff's deputy saw Moreno's heavily damaged pickup truck parked at the Goose Lake rest area, roughly 6 miles where the crash occurred. The deputy soon saw a bloodied Moreno on the rest stop's bathroom floor, either sleeping or passed out.

After several attempts, the deputy roused Moreno, who smelled of alcohol and burnt marijuana. Moreno resisted arrest and began yelling at the deputy, prompting the officer to use a Taser numerous times in order to subdue him.

A search of Moreno's pockets by the deputy turned up marijuana, four marijuana pipes and a small baggy with an unknown substance.
