Authorities will suspend prosecution against a man who was critically injured in a motorcycle accident in which he killed a passenger while driving drunk.
Instead, they will seek to have Todd Charles Gillis, 43, committed civilly because he is disabled as a result of head injuries suffered during the crash on May 23, 2009, Dakota County Attorney James Backstrom said in a statement on Tuesday.
Killed in the crash was Amber Frandrup, 25, of Eagan. She was a passenger on Gillis' motorcycle when he crashed into a car on the Mendota Bridge in Mendota Heights.
Gillis, formerly of Eagan, was charged with one count of criminal vehicular homicide on April 22.
On Monday, at a competency hearing, a retired Anoka County judge concluded that Gillis' brain injury left him unable to assist in his own defense.
"Consequently," Backstrom said, "the prosecution of this case cannot continue."
Backstrom said he would refer the case to social service workers to determine if Gillis should be committed for a disability as a result of the ruling.
