Appeals court upholds fine against contractor

The Minnesota Court of Appeals this week upheld the state's enforcement actions against a Burnsville contractor accused of misconduct.

The Minnesota Court of Appeals this week upheld the state's enforcement actions against a Burnsville contractor accused of misconduct.

Last year, the Department of Labor and Industry revoked the license of LeMaster Restoration and fined the company $40,000, of which owner Verdean LeMaster shares responsibility for paying $10,000.

As Whistleblower reported last year, an assistant state attorney general described a "troubling pattern of violations" that included unfinished projects, inflated invoices, work done without permits and abusive litigation against former customers.

Among other claims, LeMaster argued that the assistant labor commissioner abused her discretion by doubling the fines. The Appeals Court rejected those arguments.
