New York-based reporter's lawyers want to see Colorado theater shooting suspect's notebook

CENTENNIAL, Colo. — Lawyers for a FoxNews.com reporter who wrote about a notebook the Colorado theater shooting suspect sent to a psychiatrist are asking a judge to let them see it.

The notebook's contents haven't been revealed publicly, but New York-based Jana Winter cited confidential sources in reporting it included violent drawings.

Winter is fighting demands from defense attorneys to reveal her sources, who they contend violated a gag order.

In court documents filed Friday, Winter's lawyers say they should be allowed to inspect the notebook so they can argue about how significant its contents might be at trial, now that James Holmes has pleaded not guilty by reason of insanity to the July 20 theater shootings.

Prosecutors oppose the motion. Defense attorneys' position on the matter wasn't immediately clear from available court documents late Friday.
