My Sunday column described U.S. Attorney Andy Luger's effort to navigate the shifting legal terrain of police forfeiture power. I referred in the column to the case of U.S.A. vs. $25,895 in U.S. Currency, and so far the defendant money is not speaking up to say it's innocent. Anyone who wants to prevent the civil forfeiture needs to do so by late December, according to the official notice. If that doesn't happen, the money will flow into the Department of Justice's Equitable Sharing program, which divides it up among federal, state and local agencies based on their participation.
