The homeowners association and property management company for an Edina condo building have agreed to pay more than $40,000 to settle a discrimination claim made by a family with two children.

The case arose from 7000 Sandell Condominium Association, which advertised itself as an age 55-plus building, trying to bar a couple with two young boys from living in the building. The U.S. Department of Housing and Urban Development charged the association and its property management company, New Concepts Management Group of St. Louis Park, with housing discrimination because the building had not met federal requirements for senior housing.

The association took the family to court in 2011 to try to stop the children from living in the building. But HUD said that though the 18-unit building billed itself as a 55-plus residence, it did not meet federal requirements to regularly verify the age of residents and did not have rules to do that when the dispute arose.

Under terms of a consent order, the condo association and management company will pay the family $30,000, pay their attorney $12,200 and allow the couple and their children to live in the building without fear of retaliation or harassment.
