Arguments in Amy Senser's appeal of her criminal vehicular homicide conviction will be pushed back a week because the prosecutor who will argue the state's case has been hospitalized.

In an order filed Thursday, Minnesota Court of Appeals Judge Kevin Ross found that the state "has shown good cause" to reschedule from April 24 to May 1 after Assistant Hennepin County Attorney Lee Barry was hospitalized for a heart condition. He is expected to be released soon, County Attorney spokesman Chuck Laszewski said.

A jury convicted Senser on May 3, 2012, of two counts of criminal vehicular homicide for the August 2011 hit-and-run death of Anousone Phanthavong, 38, who was putting gas in his car on the Riverside Avenue exit ramp of I-94 in Minneapolis when he was struck and killed. Senser, 46, who turned herself in days later, testified at her two-week trial that she didn't know she struck a person when she left the scene that night. In briefs preceding the appeal, Senser's attorney Eric Nelson argued that she was denied a fair trial. Senser has served about nine months of a three-and-a-half year prison sentence. She is eligible for supervised release in October 2014.
