Two people familiar with the "Deflategate" legal case said that New England quarterback Tom Brady and NFL Commissioner Roger Goodell participated in unsuccessful settlement talks in New York on Tuesday.
The failure to strike a deal after about four hours of talks means a Wednesday hearing will proceed as scheduled.
The talks occurred away from the Manhattan federal court handling the case. The location was not disclosed.
Lawyers are scheduled to argue Wednesday whether it was fair for the NFL to suspend Brady for four games this season after Goodell concluded he conspired to deflate footballs before a playoff game. No ruling from U.S. District Judge Richard Berman is expected.
Brady plans to be at Patriots practice in West Virginia instead, where New England is preparing with New Orleans Saints players for a preseason game Saturday night.
The NFL suspended 49ers receiver Jerome Simpson without pay for the first six games of the season for violations of the league's substance-abuse policy.
The 29-year-old wideout, who had been a candidate to be San Francisco's No. 3 receiver, served a three-game suspension to start last season with Minnesota before the Vikings cut him as he faced more trouble.
Cards sign Johnson
Chris Johnson came to the Cardinals with no assurances about what role he will play, and he says he's fine with that.
Johnson, speaking to reporters before his first practice with his new team, said he's just glad to be back playing in the NFL.
Johnson rushed for 663 yards with the New York Jets last season after topping 1,000 in his first six NFL seasons, all with the Tennessee Titans.
Johnson has recovered from a gunshot wound to the shoulder. He was injured in March when someone opened fire on a van in which he was riding in Orlando, Fla. The driver of the van was killed and another passenger injured.
The three-time Pro Bowl player signed a one-year contract with the Cardinals on Monday.
