The Minnesota House mischaracterized the economic factors Gov. Tim Pawlenty used to justify cutting funds for a nutrition program for the elderly, blind and disabled, according to a letter filed in court Tuesday by his lawyer.
Six people who received assistance through the program filed suit against Pawlenty and other state officials last month, saying the governor wrongly used his emergency budget-cutting powers. On Friday, the House filed a friend-of-the-court brief supporting the plaintiffs, who seek a temporary injunction to get the money reinstated.
In deciding on the $2.7 billion in cuts announced in June, the governor relied on tax forecasts through 2011 and anticipated an ongoing weak economy, stated a letter filed Monday by Patrick Robben, the governor's general counsel. "Hindsight has, in fact, confirmed that determination," he wrote.
The plaintiffs say Pawlenty created the shortfall by approving spending bills then vetoing a tax bill that would have balanced the budget.
