DULUTH - Duluth City Councilor Jay Fosle has entered the race for state representative after recent news of an alleged sexual encounter between state Rep. Kerry Gauthier and a 17-year-old boy.

Gauthier, a first-term Democratic legislator from Duluth, is up for re-election in November.

The Duluth News Tribune obtained police records showing that Gauthier was investigated for allegedly having oral sex with the boy. Gauthier won't be charged.

Fosle filed paperwork on Friday to run as a write-in candidate against Gauthier and Republican Travis Silver.

Gauthier didn't respond to an e-mailed message from the Associated Press. His home voice mail was full.

He was elected in 2010 with 73 percent of the vote. House Speaker Kurt Zellers, a Republican, has called on him to resign.
