Six Republican lawmakers will get their third bite at the legal apple.

Pre-shutdown the Supreme Court refused to hear a handful of GOP Senators' case that most shutdown spending would be unconstitutional. Soon after a Ramsey County judge joined in the rejection of a slightly different argument.

But once the shutdown started and they group, now joined by two House members, tried again. This time saying the judicially led decisions on what can and cannot be funded in a shutdown are illegal and unconstitutional. This time they hit the mark.

The Minnesota Supreme Court Monday scheduled July 27 oral arguments on their petition.
