A bill proposed by Sen. Al Franken, D-Minn., would update and strengthen the 1977 U.S. Fair Debt Collection Practices Act, which allows debtors to sue collectors who violated federal law. The bill would:
• Allow only judges, not debt collectors, to use arrest warrants against debtors for not responding to a creditor's lawsuit.
• Require collectors to give consumers more information about debts, including the original creditor's name and breakdown of fees and interest.
• Require collectors to document what is owed.
• Increase the civil damages for wrongdoing, and allow triple damages for willful acts and court injunctions for continued violations.
