ATLANTA — A federal judge from Alabama accused of hitting his wife in an Atlanta hotel room can have a misdemeanor charge against him dismissed if he completes a court program that includes domestic violence intervention.

A Fulton County judge agreed to allow U.S. District Court Judge Mark Fuller to enter the pre-trial diversion program, which also includes a substance abuse assessment.

The 55-year-old Fuller was stripped of his cases following his Aug. 10 arrest. Police said Fuller's wife had visible cuts but refused to be taken to the hospital.

The judge said in a statement he deeply regrets the incident. He says he looks forward to addressing the concerns of the court and "hopefully" returning to the bench.
