A judge gave no further jail time to a former Hopkins elementary school employee who admitted to sexually touching female students.

David J. Madrigal, 55, of Minneapolis, was sentenced by Hennepin County District Judge Lisa Janzen on Thursday after pleading guilty to second-degree criminal sexual conduct in the encounters at Eisenhower Elementary School.

Madrigal was put on supervised probation for five years. His sentence also stipulates that he has no contact with minors, stays at least three blocks away from any Hopkins School District building, abstains from alcohol and illicit drugs, owns no firearms and registers with the state as a predatory offender.

The plea deal called for incarceration for 90 days. At sentencing, Madrigal was given credit for 60 days in jail. Janzen ruled that his sentence in the county workhouse was satisfactorily completed, according to court records.

Madrigal, while employed as a student support specialist, touched at least two students, and investigators found sex-oriented websites on his computer, along with notes referencing similar websites.

Before joining the Hopkins School District, he worked as a special education assistant for the Minneapolis Public Schools from 2005 to 2014, when he resigned in lieu of being fired for showing up to work intoxicated and swearing at a student.

On April 6, counselors at Eisenhower received an anonymous letter saying Madrigal, who joined the school in 2015, had been touching sixth-graders "in a manner that made them feel scared." Officials identified the students who wrote the letter and removed Madrigal from the school.

Several female students told investigators that Madrigal would touch them, including rubbing their shoulders, arms, thighs and lower back. He would also stare at their bodies, comment on how they looked and give them candy. He attempted to kiss a 12-year-old student.

Madrigal's criminal history includes convictions for carrying a pistol without a permit, possessing alcohol in a public park and hit-and-run.
