Former GOP state Senate staffer Michael Brodkorb had a blood-alcohol concentration over the legal limit at the time of a crash last month, according to the State Patrol.
Testing determined that Brodkorb had a blood-alcohol level of 0.10 percent, which is above the legal limit of 0.08.
Authorities said Thursday they have submitted the case to Lilydale City Attorney Tom Lehmann for possible charges.
Brodkorb, 39, was seriously injured Jan. 23 when his car crashed into the base of a bridge on Interstate 35E and he was ejected. He was hospitalized for several days at Regions Hospital in St. Paul.
Brodkorb declined to comment Thursday. A regular Twitter user, he tweeted Wednesday: "it's good to be back" and "more progress each day!"
The longtime GOP operative lost his job as the Republicans' Senate communications chief late in 2011, after then-Senate Majority Leader Amy Koch admitted publicly that the two were having an affair.
She stepped down from leadership, and Brodkorb was fired.
A lawsuit he filed against the Senate alleging wrongful termination is still working its way through the courts.
