Mankato School District settles suit over girl's injury

Last update: November 9, 2009 - 9:45 PM

A legal settlement will pay thousands of dollars to a family whose middle school student was injured playing kickball during summer school in North Mankato, Minn.

The settlement, filed last week in Blue Earth County District and scheduled for final judicial approval next week, calls for a payment of $25,000 from the Mankato School District's insurance provider to the family of Amanda Smith.

Smith was 11 in June 2008 when she broke her ankle after sliding on a file folder that her teacher had used as a base at Dakota Meadows Middle School.

The settlement will cover legal and medical expenses and set up an annuity for Amanda that matures on the girl's 30th birthday.

Amanda's mother, Rachal Karstens, is declining comment on the case, said her attorney.
