1 of 2 charges dropped for man arrested during RNC

Last update: October 3, 2008 - 12:11 AM

A charge of second-degree assault has been dismissed against a man who had been accused of throwing a 50-pound bag of sand off John Ireland Bridge and onto Interstate 94 in St. Paul on the first day of the Republican National Convention.

David T. Mahoney, 25, still faces a charge of terroristic threats. At a hearing Thursday, District Judge Kathleen Gearin found there was no probable cause to sustain the assault charge because there were no named victims in the complaint.

Paul Gustafson, a spokesman for the Ramsey County attorney's office, said law enforcement is confident they can provide the names of a victim or victims and the assault charge can be reinstated.
