Both sides seek new venue for Zabawa trial

Last update: September 14, 2007 - 11:23 PM

The Minnesota attorney general's office agreed with defense attorneys Friday that the trial of Michael Zabawa, accused of killing a father and son and wounding the mother in rural Waseca, should be moved out of Waseca.

The judge has not made a decision on the change of venue, but agreement on the issue from both sides is rare.

Zabawa is accused of killing Tracy Kruger, 40, and Alec Kruger, 13, and seriously wounding Hilary Kruger, 41, on Feb. 3 in their rural Waseca home.

The shootings have drawn media attention and caused turmoil in the town of 9,000, making it difficult to get a fair trial there, according to Christine Funk, an attorney for Zabawa.
