Renter's rights

Last update: October 28, 2007 - 9:32 PM

Renters' rights

• In general, tenant rights are governed by when their lease starts and how long it lasts.

• The owner of occupied rental property has six months to pay up after a foreclosure triggers a sheriff's sale.

• Renters who signed a lease before the sale can stay until the end of the six-month period, assuming their lease runs that long -- and sometimes for 30 days after that, depending on when they're given notice

• Those who move in after a sale lack that protection and face a quick eviction.

• The landlord also must keep making repairs and paying utilities if the lease requires.

• A tenant can go to court to have the rent escrowed to pay for utilities/repairs, etc.
